Terms of Service

What you are buying, what it costs, what happens if it does not work out, and what you walk away owning. No hidden clauses, because there is nothing here worth hiding.

The short version. Two ways to start. Starter Site: $950 one-time for a real website, no monthly commitment required. Done-for-You Intake System: $1,500 to set up and $297 a month to run, month to month, cancel any time. If the Intake System is not answering and following up on your leads in the first 30 days, cancel and keep the website and your domain. When you leave, your website, domain, calendar, and lead data all come with you.

1. Who you are contracting with

Primed & Booked is operated by Matthew Perry as a sole proprietorship, based in San Luis Obispo County, California. In these terms, "I" and "me" mean Primed & Booked, and "you" means the business or person buying the service.

By using this site or buying a service, you agree to these terms. If you do not agree, do not use the service.

2. What the service is

There are two plans. Starter Site is a one-time website build. The Done-for-You Intake System is a managed service that adds automated response and follow-up on top of it.

The software and tool costs required to run the Intake System are included in the monthly price. You do not need to buy, set up, or manage separate accounts for it. Missed-call text-back requires an EIN and a business (non-cell) phone line, plus a 10–15 business day carrier registration before it goes live — see Section 6.

Both plans include our Google Business Profile Setup Guide: a step-by-step walkthrough so you can claim and complete your own listing in about an hour. You keep full ownership and control of your profile.

3. Pricing and payment

Done-for-You Intake System

Payment is processed through Stripe. The Intake System's monthly charge recurs on the same date each month until you cancel. If a payment fails, I will contact you before anything is interrupted, and I will not quietly shut off a working system over a card that expired.

4. The 30-day guarantee

This applies to the Done-for-You Intake System. If your system is not answering and following up on your leads within the first 30 days after launch, tell me and I will stop the monthly charge. You keep the website and your domain.

To be straight with you about what this is and is not: the setup fee is not refunded, because the build work is already done, and you keep the result of it either way. What the guarantee removes is the risk of being locked into paying monthly for something that is not working for you.

Starter Site has no monthly charge to guarantee against — it is a one-time build governed by the revision terms in Section 3a instead.

5. Cancellation, and what you own

There is no long-term contract and no cancellation fee. Cancel any time by emailing me.

When you cancel, I hand over your domain, your website, your calendar setup, and your lead data. It is yours. I run it so you do not have to, but I do not hold it hostage to keep you as a client.

Handover takes a few business days, since some transfers depend on registrars and third-party services that set their own timelines.

6. Timelines

That last step waits on the phone carriers approving your business to send text messages, which is a required step for every business in the United States. That approval is not mine to grant or to rush, and it occasionally takes longer than a week. Everything else in your system works while it is pending. Starter Site has no carrier step — no EIN, no registration, no waiting period.

These are estimates based on normal conditions, not contractual deadlines. If something is going to run long, I will tell you rather than let you wonder.

7. What I need from you

The service is done for you, but it is not done without you. For either plan, I need:

Realistically this costs you about an hour of your time in total. If I cannot get what I need, the timeline pauses rather than the work getting done wrong.

8. The $97 intake audit

The intake audit is a separate, one-time service. For $97 I contact your business as a customer would, time the responses, and send you a written report on where leads are getting lost.

9. What I do not promise

I want this section to be honest rather than lawyerly, because overpromising is how this industry earns its reputation.

I can promise that the system will be built, that it will work, and that I will keep it running. I cannot promise a specific number of leads, a specific revenue figure, or a specific return on your investment. Those depend on your market, your pricing, your reputation, your follow-through on the leads it catches, and plenty of other things outside a website.

What the system does is make sure the people already trying to reach you actually get through, and get an answer fast. That is a real and measurable improvement for most contractors. It is not a promise of growth, and anyone who does promise you that number is guessing.

10. Third-party services

Your system runs on outside platforms, including hosting, scheduling, messaging, and email providers. Their own terms and uptime apply to their parts of the service. I choose them carefully and I manage them for you, but I do not control them, and I am not responsible for an outage or policy change on their end. If one of them fails you, I will work the problem rather than point at them.

11. Acceptable use

You agree not to use the service for anything unlawful, misleading, or abusive, including sending messages to people who have not contacted your business, or advertising services you are not licensed to provide. Messaging systems I build for you must be used in line with carrier rules and applicable law. I may suspend or end service for a serious violation.

12. Limitation of liability

To the extent the law allows, my total liability for any claim relating to the service is limited to the amount you paid me in the twelve months before the claim. I am not liable for indirect or consequential losses, including lost profits or lost business opportunities.

Nothing in these terms limits liability for fraud, or for anything that cannot legally be limited.

13. Changes to these terms

If I change these terms, I will update the date at the top of this page. If a change materially affects existing clients, such as a price change, I will tell you directly by email before it applies to you. I will not change your price mid-month without telling you first.

14. Governing law

These terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in San Luis Obispo County, California.
